The change order that ate the float

Change Order #12 adds structural steel and rebar at Level 08 — $245,000 and ten days. That's every day of float you had. You price it, resequence around it and write the notice before liquidated damages start.

Sample: Case File 01 — Managing a prompt payment dispute

Background

A project manager at a subcontracted forming company tracks progress billing and payment from the construction manager overseeing the project for the owner. Payment timing directly affects the subcontractor's ability to meet payroll, pay suppliers and keep crews mobilised on site.

The problem

An end-of-April progress invoice nears its statutory due date with no payment confirmation. Prompt payment legislation requires the owner to pay a proper invoice within 28 days absent a notice of non-payment, and the contractor to pay subcontractors within 35 days. A cash flow gap is imminent.

What the PM did

  • Sent a documented written reminder several days before the deadline, naming the invoice, its submission date and the exact due date.
  • Quoted the specific statutory section, framing it as a compliance matter while keeping the tone collaborative.
  • Copied internal leadership, accounts receivable and the CM's project team, creating a paper trail nobody could lose.
  • Assessed the CM's reply, which revealed a pay-when-paid clause layered on top of the statutory baseline.
  • Asked for a specific anticipated payment date rather than accepting "in process" as an answer.

Lessons learned

  • Don't wait for an invoice to go overdue — an early reminder signals you're tracking terms.
  • Cite the contract and the law, but lead with collaboration. You establish grounds for escalation without burning the relationship.
  • Know the difference between statutory and contractual payment terms — subcontracts layer conditions on top of the legislated baseline.
  • Always ask for a specific date. A vague assurance doesn't help cash flow planning; a committed date does.
  • Keep the paper trail, with the right people copied.
